the gist of it boils down to this. A game company has decided to not agree to the GSL terms but publish 4th edition compatible material. The contention is they don't have use the GSL if they are not posting the SRD material or using the d20 compatible graphic. It will be really interesting to see what wizards reaction to this is. The thing is the rules of the game themselves can't be trademarked or copyrighted. You can copyright the associated text around the rules but not the rules and mechanics of a game.
It should be interesting to watch where this goes.
